Buyer agency has been used in California, Arizona, and other states for years.  Those states differ on the fact that they are buyer default states where Wisconsin is a seller default state.  This means that a "Real Estate Broker" owes a fiduciary duty to the default party.  In other words a "Real Estate Broker" needs an agreement with the Buyer to properly represent their interests, otherwise we are representing the Seller in Wisconsin.  Buyer agency is used extensively in other states in the residential real estate business and in Wisconsin for the commercial real estate business to find land sites for build to suit national tenants.  The law is relatively new in Wisconsin and is just starting to be used in the residential and commercial business.
